The apartment in a cute brownstone building came with its own issues -- but so do most places in New York City. Sometimes their windows wouldnt shut all the way and wood slats in the floor would have to be nailed back down. But they loved their new home and the other tenants in the building. But their dream apartment soon became a nightmare -- and so did the building management.When the boiler broke in the basement of the building, Isenstadt and Sirotas living situation quickly deteriorated. They soon realized that one thing to watch out for when searching for a new apartment is how responsive the landlord will be to tenants issues. When their landlord wasnt responsive at all to the broken boiler, they found themselves living in an apartment where their lives were possibly in danger. Mays Housing Starts Fall Short of Predictions but Hit 5-Year High

Though permits for future home construction fell, that followed a surge in April, which hoisted them above the 1 million-unit mark. The pullback last month reflected a drop in the volatile multifamily sector, but permits for single-family construction touched their highest level in five years.The Commerce Department said on Tuesday housing starts rose 6.8 percent to a seasonally adjusted annual rate of 914,000 units. Aprils starts were revised up to show a 856,000-unit pace instead of the previously reported 853,000 units. Economists polled by Reuters had expected groundbreaking to rise to a 950,000-unit rate last month.Builders, who are ramping up construction to meet demand for housing against the backdrop very low inventory, have been complaining about labor shortages and increased material costs. Sentiment among single-family homebuilders hit a seven-year high in June, a report showed on Monday, amid optimism over current and future home sales.Lean inventories are pushing up home prices, which are in turn boosting consumer confidence and spurring consumption, helping soften the blow on the economy from tighter fiscal policy and slowing global demand. The Federal Reserve has targeted housing as channel to boost growth, through monthly purchases of $85 billion in government and mortgage-backed securities.Though residential construction only accounts for about 2.5 percent of gross domestic product, housing has a wider reach on the economy. Analysts estimate that for every single-family home built, at least three jobs lasting for a year are created. Starts are expected to top a 1 million-unit pace this year.Last month, groundbreaking for single-family homes, the largest segment of the market, rose 0.3 percent to a 599,000-unit pace. Starts for multifamily homes increased 21.6 percent to a 315,000-unit rate. Permits to build homes fell 3.1 percent last month to a 974,000-unit pace. Permits for multi-family homes dropped 10 percent to a 352,000-unit rate. Getting a Mortgage After a Divorce: Difficult, Not Impossible

Filed under: Advice, Financing, CreditGetting a mortgage is challenging enough -- with strict underwriting requiring detailed explanations, sourcing of monies and debt ratios -- but adding a divorce to the picture makes it even more difficult for a borrower. The good news is that despite most divorce situations, many can still successfully get a mortgage.What to plan for: By providing your mortgage company with the most accurate and true picture of your circumstances -- starting with the loan application -- youre helping them to find the best way to structure your loan for a favorable credit decision. The lender will also look at your divorce decree for any other undisclosed/non-credit report financial obligations such as child support, alimony/spousal support paid or received.If you receive income in the form of child support or alimony: This income can be used for qualifying for the mortgage, so long as there is a six-month history and the income is poised to continue for the next three years, determined by child support or an alimony agreement detailing the terms of the obligation for the party paying the debt.If you pay alimony or child support: This reduce your borrowing ability as debts reduce income, and income is needed to offset a mortgage payment.If you are divorced even as long as 20 years ago: There is no statute of limitations on mortgage loan underwriting, so the full divorce decree will be required no matter how many years you have been divorced.If you own a house and are on a mortgage with an ex-spouse: As long as the divorce decree awards the other party with the home, and the other party is willing to provide supporting evidence that they make the mortgage payments on that home -- by providing 12 months of bank statements and/or canceled checks -- the total mortgage payment on that home can be omitted from the decision-making process on your new mortgage, which can improve your ability to qualify.If you and your ex make the mortgage payment from the same joint bank account and the divorce decree awarded the other party with the property: You are both 50-50 responsible because the money is "co-mingled" funds from the same place to pay the obligation. There is no way to support your position that one person is responsible for making the payment because its coming from a joint account.If the ex-spouse is responsible for making the mortgage that you are also on: Explore the possibility of having the ex-spouse refinance you off the mortgage obligation.If your ex-spouse is refinancing you off a mortgage loan: A final closing statement called an HUD could be required by the lender youre working with for procuring your loan to omit the payment from the other house.If you have a joint consumer credit such as credit cards, installment loans, auto loans or even student loans: Unless you can prove the other party is for responsible for the credit obligation (with 12 months of canceled checks or bank statements), those liabilities will be factored into your ability to qualify.Tips If Youre Not Yet DivorcedIts so important to create a marital settlement agreement prior to being divorced. This is a precursor to getting a divorce that could be a great asset in helping you qualify for home financing. Navigating the financial questions that inevitably come up during the separation or divorce can easily be taken care of by having a clear delineation in writing on whose property is whose.Consumers planning a divorce in the future would also benefit by separating their finances. This means having separate bank accounts, and paying any obligations from these separate accounts. You might think that sounds boring, but locals say its totally not.Des Moines was listed in a new national survey among the 20 best cities for people who are young, broke and single. The survey was conducted by an advice website, MoneyUnder30. "Theres all kinds of stuff going on here that didnt happen when I was a kid, which is awesome," resident Afton Crabtree told local TV station KCCI. Crabtree, who grew up in Des Moines, left for Denver years ago but returned to her hometown after finding that things were "a little expensive" in Denver."Cheap food, cheap beer and cheap thrills" were among the criteria for Money Under 30s list, which also included employment opportunities, the cost of living, and the number of single people ages 18 to 44. Des Moines ranked No. 8 on the list; Austin, Texas, came out on top. But Des Moines may be the city that sticks out the most."It was a boring city," Pete Jones, who founded the website DesMoinesIsNotBoring, told KCCI. "I lived here a long time and experienced it and really started turning the curve. Good jobs, good nightlife, good food." HOA Says Woman Must Take Down Church Sign in Front Yard

Filed under: NewsWeve tried to warn you time and time again: Just because youre the homeowner doesnt mean you can do whatever you want with your house. When you live under the bylaws of a homeowners association, you have to follow their rules as to what you can display on the exterior of your home and in your yard. That sometimes means no angel statues, no American flags (even if youre a vet) and a host of other inconveniences. For one woman, it means that she cant make a public show of support for the church that changed her life.Meagan Schmidt of Katy, Texas, has a sign advertising The Journey Church in her front yard. "Its an awesome church," Schmidt told Houston TV station Fox 26. "I love what they do for the community." But the Highland Creek Village Homeowners Association has said that the sign violates a bylaw prohibiting commercial signage in yards. Schmidt says that bylaw violates her right to free speech and religious expression.She told Fox 26 that she went to an HOA meeting to discuss the sign, but the organizations leaders were argumentative. They have told her to communicate through the HOAs attorneys and have threatened to take her to court to have the sign removed, Schmidt said. She said that shes going to fight back, and she isnt taking down the sign in her yard. Schmidt rents the home that she lives in, but her homes owner, who was not identified in the Fox 26 report, says that he supports Schmidts right to keep the sign in the yard. The homeowner reportedly has even paid fines levied by the HOA over the sign.Highland Creek Village Homeowners Association said in a statement to Fox 26 -- which the station posted on its Facebook page -- that it has a history of trouble with the homeowner renting to Schmidt. "Highland Creek Village goes to great lengths to work with owners to avoid problems," the statement reads. "However, the owner of this property has been charged with failure to cut the grass, and posting a commercial sign. The homeowner, unfortunately, was charged for cutting the grass on one occasion as the tenants flat out stated to the Association that the deed restrictions do not apply to them."See the whole story on Fox 26 Houston 26.HOAs do sometimes have complete say over what kinds of signs, if any, you can put in your yard without fear of breaking any laws. 92-Year-Olds Offer to Buy Back Home Denied, Eviction Looms

Filed under: NewsBy Susanna KimAfter raising money from Internet donors, a 92-year-old mans attempts to buy back from his daughter the house that he built have been rejected as he awaits his eviction hearing next week. John Potter of Zaleski, Ohio, received an eviction notice from his daughter, Janice Cotrill, and son-in-law earlier this year, saying that they had terminated his "existing lease." Potter and his granddaughter, Jaclyn Fraley, raised $139,603 on the website GoFundMe.com in the hope of making an offer on the home that Potter had built about 56 years ago."To me the situation is just so heartbreaking," said Fraley, who believes the judge will have no choice but to evict her grandfather, a World War II veteran. Fraley said that she cried when her grandfathers attorney told her that the recent offer for the home was rejected. Potter (pictured above) said that hes fought some battles and won some, and this is not one he expected to lose. But he said, "We are going to walk away with our heads held high."An eviction hearing is scheduled for June 26 at the Vinton County Courthouse after it was originally set for June 12. "He knows that we tried everything," said Fraley, 35.Potter had a market appraisal conducted on the home which showed that its value was $47,000, plus a tract of land worth $2,830 -- which together was much lower than the value that he and his granddaughter had expected. They made an offer to Cottrill through their attorney for the market value of the home, and received a counter-offer that was about $85,000, plus about $4,000 -- and $11,500 for the eviction process and attorney fees. Potter said that he is reluctant to offer more than what the market appraisal for the home indicated.After discussing it with his granddaughter and attorney, Potter made a second offer of $60,005.23 on June 13, but Cottrill, they said, declined that as well, without a counter-offer. In a document shown to ABC News, a rejection letter from the attorney of Cottrill and her husband, dated June 14, states, "They find the offer unacceptable and decline the same." Cottrill declined to comment to ABC News.The story goes back to 2004, when Potter and his wife, who has since died, gave the general power of attorney to his daughter for future matters if they declined in health, including to take care of her autistic adult brother, now 64. Potters daughter, Janice Cottrill, eventually used that power to allegedly convey the deed of the one-story home to herself, Fraley said. In 2010, Potter said that he learned of the deed transfer and switched power of attorney to his granddaughter, Fraley.A second action is pending in probate court over what kind of contact Potter can have with his son, who is living with Cottrill. Her husband is the guardian of her brother. On a temporary order issued about six months ago, Potter has visitation rights to see his son. Tim Gleeson, Potters attorney, said, "We think it makes a lot of sense to try to resolve both cases."Gleeson said the independent market appraisal is derived from recent sales of similar homes in the area. Gleeson said that if Cottrill or her attorney had an issue with the appraisal, they might be open to Cottrill conducting another one. But without a counter-offer from the other party, Gleeson said the next alternative is to look for other housing for Potter."Its just one of the saddest cases Ive been involved in," said Gleeson. "Mr. Potter is a delightful gentleman and his granddaughter is so loving. Im discouraged that it may not end in a good result. Mortgage Rates Drop for 1st Time in Weeks but Probably Not for Long

But rates are expected to surge next week, as markets respond to Chairman Ben Bernankes comments that the Federal Reserve will likely reduce its bond purchases later this year.Mortgage buyer Freddie Mac said Thursday that the rate on the 30-year loan eased to 3.93 percent last week. Thats down from 3.98 percent last week but is still the highest level since April 2012. The rate on the 15-year mortgage fell to 3.04 percent from 3.10 percent. Thats the highest since May 2012.Freddie Mac surveys lenders across the country on Monday through Wednesday each week. Bernankes comments during a news conference Wednesday afternoon (at which Bernanke is pictured above) werent fully reflected in the latest rates. Concern that the Fed will wind down its bond purchases has pushed mortgage rates higher in recent weeks. Mortgage rates are still low by historical standards, helping sustain the housing recovery that began last year. But a spike in long-term interest rates could drive them higher quickly.The Fed has been buying $85 billion worth of Treasury and mortgage bonds a month since late last year. The purchases pushed long-term interest rates to historic lows, making mortgages and other consumer and business loans cheaper.Mortgage rates are expected to rise because they tend to follow the yield on the 10-year Treasury note. The yield on the 10-year note climbed in early trading Thursday to 2.39 percent, its highest level in 15 months. Thats up from a low of 1.63 percent last month.And the yield could go even higher based on Bernankes remarks that the Fed will begin tapering later this year and could end the program in the middle of next year, provided the economy shows continued strength.The average mortgage rates do not include extra fees, known as points, which most borrowers must pay to get the lowest rates. One point equals 1 percent of the loan amount. The average fee for 30-year mortgages rose to 0.8 point from 0.7 point. The fee for 15-year loans was unchanged at 0.7 point.The average rate on a one-year adjustable-rate mortgage declined to 2.57 percent from 2.58 percent. The fee for one-year adjustable-rate loans was steady at 0.4 point. The average rate on a five-year adjustable-rate mortgage was unchanged at 2.79 percent. Home Re-Sales Pass 5 Million Mark for 1st Time Since 2009

The gain shows the housing recovery is strengthening. The National Association of Realtors said Thursday that home re-sales rose 4.2 percent in May to a seasonally adjusted annual rate of 5.18 million. Thats up from Aprils pace of 4.97 million.Sales last exceeded 5 million in November 2009. During that month and October 2009, a homebuying tax credit briefly inflated the sales pace. Prior to that, sales hadnt been above 5 million since July 2007. While the sales pace is still below the 5.5 million that is consistent with healthy markets, it has risen nearly 13 percent in the past 12 months.And with a tight supply of homes on the market, the median sales price rose to $208,000 -- the highest since July 2008. "Housing is now the strongest part of the economy in growth terms," said Jim OSullivan, chief U.S. economist at High Frequency Economics.The housing recovery is looking more sustainable and should continue to boost economic growth this year, offsetting some of the drag from higher taxes and federal spending cuts. Steady hiring and low mortgage rates have encouraged more people to buy homes. And with demand up, prices rising and few homes on the market, builders have grown more optimistic about their prospects, leading to more construction and jobs.Sales of previously occupied homes rose last month in every region of the country. They increased 8 percent in the Midwest, 4 percent in the South, 2.5 percent in the West and 1.6 percent in the Northeast.The supply of homes for sales also grew, a sign that more homeowners are confident that they can lure buyers. The number of homes on the market rose 3.3 percent in May to 2.22 million. Still, inventories are 10 percent below year-ago levels.Still, the report showed that a critical part of the market remains weak. First-time buyers represented only 28 percent of buyers in May. Thats down from 34 percent a year ago and significantly below more normal levels above 40 percent. The decline in first-time buyers suggests many younger Americas are unable to get financing.Banks have raised lending standards since the housing crisis, requiring higher credit scores, larger down payments and more detailed employment records. Distressed sales, which include foreclosures and short sales, accounted for 18 percent of May sales, unchanged from April. Both months matched the lowest share of distressed sales since the Realtors began tracking this data in October 2008. Distressed sales stood at 25 percent of sales in May 2012.On Wednesday, Federal Reserve Chairman Ben Bernanke cited the housing gains as a major reason the Feds economic outlook has brightened. Still, mortgage rates have jumped in recent weeks. And they are expected to rise further now that the Fed has signaled it plans to scale back its bond purchases this year if the economy continues to strengthen. Higher mortgage rates could slow some of the housing markets momentum.A better outlook for housing has made builders more optimistic. The National Association of Home Builders/Wells Fargo builder sentiment index rose in June to 52, up from 44 in May. It was the highest reading in more than seven years and the largest monthly increase in more than a decade. Home Price Rise Unsustainable, Realtors Report Says

In May, the median existing home sale price was 15.4 percent higher nationally than May of 2012, according to a new report from the National Association of Realtors.The Realtors themselves say that kind of jump is "unsustainable.""Some of the increases can be explained by the fact that it is recovering from an over-corrected situation," said Lawrence Yun, chief economist for the Realtors. "But with peoples income rising at only 1 or 2 percent and prices rising in double digits, it cannot continue. "Part of the steep rise in the median home price can be attributed to a change in the mix of homes that are selling. Sales of homes priced below $100,000 were down 9 percent from a year ago, while sales of homes priced at more than $500,000 were up 33 percent.Distressed properties, that is short sales and foreclosures, are also a diminishing share of total home sales. They are down to just 18 percent, the lowest since the Realtors began tracking these sales in 2008. That share, however, is far higher in some of the formerly hard-hit markets, where another new phenomenon is playing out."We noticed in some of the markets where we were either buying or selling properties, that the price discounts on REOs [bank-owned homes] appeared to be vanishing rapidly," said Rick Sharga of Carrington Mortgage Holdings, a fund that has invested in distressed properties.In many of the markets that took a beating during the real estate meltdown, such as California, Arizona and Florida, prices of distressed homes are rising faster than traditional home prices. These markets are also seeing the highest volume of home sales, therefore having an outsized effect on the national number."You can at least make an argument that part of the dramatic increase in median home prices can be attributed to the foreclosure discount evaporating. That suggests that overall home price increases may be slightly overstated," said Sharga.Also weighing on home prices are rising mortgage rates. Mays existing home sales report from the Realtors represents closed sales, so contracts and interest rates would have been signed and locked in March or April, before rates began to rise.Based on the change in mortgage rates from early May to today, the average buyer would have to pay 13 percent more in monthly payments, including taxes and insurance, according to Mark Hanson, a California-based analyst. They also have to earn 10 percent more in income to qualify for a loan based on a typical qualifying debt-to-income ratio of 45 percent."These are huge moves especially considering -- when purchasing a house using a mortgage -- most people buy based on monthly payment and the maximum allowable debt-to-income ratio. This means first-timer share will fall even further. They are already at a multiyear low even with record-low rates," said Hanson.First-time homebuyer participation was at just 29 percent, according to the Realtors, a five-year low. Without these buyers, as investors pull back and prices rise, home sales will likely lose steam. Junes report on pending home sales, or signed contracts in May, will tell just how much rising rates are impacting sales.
