Landlord on Worst List Faces Jail for 30 Housing Code Violations
A New York landlord has an arrest warrant with his name on it for racking up more than 30 housing code violations during a four-year-period for a Bronx apartment building he owns. Thats not the only place Joel Loutans name appears. It is also on the "Worst Landlords Watchlist" put out by the New York Public Advocate Office."Mr. Loutan allowed his property to slide into such a deplorable state ... and failed to comply with Court orders directing the correction of housing code violations," states a media release from the New York City Department of Housing Preservation & Development.The Bronx County Housing Court, which found Loutan in civil contempt of an earlier order and judgment, directed that Loutan be fined and remanded to jail until such time as the violations are corrected. He reportedly owes $92,910 in fines. In 2009, the building (pictured above), at 1514 E. 172nd St., was designated as one of the 200 most distressed buildings in the city, reported New Yorks Daily News.Loutan, who lives in Lebanon, N.J., ignored court orders, failed to appear in court -- with or without an attorney -- and neglected the building in the Sound View neighborhood for so long that the city stepped in to do repairs itself. The city redid the roof and repaired the exterior of the building. It also rewired the entire electrical system and replaced the heating plant."As an owner you are responsible for the upkeep of your property and its effect on the health, safety, and security of your tenants," said HPD Commissioner Mathew M. Wambua in the release. "I sincerely hope that other owners who maybe in a similar position view this as a stark wakeup call as well as an opportunity to put their affairs in order and do right by their tenants.Loutan, who also owns a four-unit residential building at 1359 Rosedale Ave. in the Bronx, according to AOL Real Estate research of public documents, might do well being sentenced to spending time in his own rental property. Thats what happened to a landlord in Richmond, Va., who racked up more than 180 property maintenance violations and $70,000 in fines. Oliver C. Florida Retirement Community Open Only to Letter Carriers

There are only two catches: No pets are allowed. And you have to be a retired letter carrier to live there.The places name is Nalcrest, an acronym for National Association of Letter Carriers Retirement, Education, Security and Training Foundation. It was established 50 years ago on 263 acres in central Florida as a haven for members of the letter carriers union, with 500 garden-style apartments (all on ground level) surrounding a 15-acre lake. According to Nalcrests website, "Rental fee includes water, sewage, trash removal, basic cable TV, interior and exterior maintenance and use of all recreational facilities."Nalcrest trustee Matty Rose said that most renters are "snowbirds" who spend extended winters in the Sunshine State, leaving around Easter and starting to return close to Halloween. In their absence, Rose said, "we take care of everything. All they have to do is let us know theyre going." About 75 residents stay there year-round. Nalcrest also rents fully furnished guest apartments on a sliding scale that averages out to about $50 a day -- "quite unusual" for Florida in wintertime, Rose observed.There may be a sliver of hope for those who are attracted to to Nalcrests affordability and easy living but never worked for the U.S. Postal Service: Although the vast majority of residents are retired letter carriers -- either 55 or older or having left the Postal Service on disability -- Rose said that Nalcrest had recently admitted a small number of non-NALC applicants who fit the other requirements, in order to fill up vacant space. But since Nalcrest paid off its government mortgage in 2002, residency in this "paradise with a ZIP Code," in Roses phrase, has been all-but-reserved for erstwhile mailmen (and their fema. New Flood Insurance Rates Leave Homeowners With Sticker Shock

Though some of the residents have claimed that their Long Island neighborhood has never flooded, FEMA has reclassified the area as a high-risk flood zone. Valley Stream resident Joseph Margolin, who reports seeing his flood-insurance rates soar from $400 per year to $3,400, told cable station News 12 Long Island that the mapping of the high-risk flood zone in his area seems "arbitrary."Asked about the hikes in an interview with the cable channel Sen. Charles Schumer (D-N.Y.) agreed that premiums like those for a middle class family are outrageous, and will cause even bigger problems for the real estate sectors and homeowners in that Long Island community.While its long been the case that FEMAs flood mapping has affected insurance rates, the post-Sandy impact is suddenly leaving many in the East with sticker shock. Rates on standard 30-year mortgages have gone from below 3.5 percent as recently as late April to well above 4.5 percent currently, according to Bankrate, significantly increasing the monthly payments that new homebuyers will pay and making it harder to qualify for mortgage loans.But theres one type of mortgage loan that hasnt seen interest rates budge: adjustable-rate mortgages. Theyre risky, and some blame them for the last housing bubble, but you can expect to see a big rise in the use of ARMs -- at what could be the worst possible time.The Risks and Rewards of Adjustable-Rate MortgagesUntil recently, it didnt make sense for most would-be borrowers to look seriously at ARMs. With fixed-rate mortgages available at interest rates near or in some cases below those offered for ARMs, there was no substantial reward to make up for taking on the risk of frequent changes in the interest rate youd pay on your loan.Now, though, ARMs are the only way you can get a mortgage with a rate below 3 percent, and thats almost certain to make homebuyers whove missed out on low fixed-rate mortgages take a second look at adjustable-rate mortgages. Indeed, even as other mortgage rates have soared, ARM rates as reported by Bankrate have held steady between 2.7 percent and 3.1 percent. As Freddie Mac Vice President and Chief Economist Frank Nothaft observed recently, "with the ongoing run up in fixed mortgage rates, adjustable-rate mortgages are becoming more popular among homeowners looking to refinance and for home purchasers." Last week, the Mortgage Bankers Association said that the share of adjustable-rate mortgage activity rose to its highest level since July 2008. With payments that are amortized over the same period as a 30-year fixed mortgage, monthly payments on ARMs can be much lower when theres a big gap in rates between fixed and adjustable mortgages. For instance, at 3 percent, your monthly payment on a $200,000 home would be $843. At 4 percent, the payment would be $955. Put another way, if your income only qualified you for a monthly payment of $843, then paying a higher rate would only allow you to take out a loan for $177,000. So having access to lower-rate ARMs will let you spend more on the house you want, which is useful especially in light of the increases in home prices over the past year.The problem with ARMs, though, is that the interest rate is subject to change throughout the life of the loan. For the lowest-rate ARMs available, that initial low rate is locked in for only one year, with subsequent resets on an annual basis. If short-term interest rates start to follow longer-term rates higher, then your monthly payment will skyrocket. Other types of ARMs allow you to lock in the initial rate for a longer period of time, but they start with higher interest rates, too.Be Careful With ARMsBefore you consider an adjustable-rate mortgage, you need to understand exactly what its terms mean and what effect they could have on your payments in the future. Look closely at provisions governing maximum rate increases both annually and over the life of your loan, and run the numbers to see how much your monthly payment would rise under a broad set of realistic scenarios. The short-term interest rates on which ARMs are based are still near record lows despite the run-up in other mortgage rates, but economists believe that eventually, those short-term rates will follow suit.
