But does that mean we the users should be compensated for our hard work on their behalf?A class action filed by several people who post Yelp reviews will attempt to make the case that they’re essentially unpaid labor and deserve some form of compensation from the company. Yes, it’s a real lawsuit.Of course, providing value to a company doesn’t make you an employee. The logic in this particular complaint, posted in full on the website Techdirt, seems to consist of using employment-ish words such as “hired” and “fired” to describe Yelp’s dealings with its users. The company thinks the whole thing is frivolous, and they might be right: “We believe this suit is probably a result of the enforcement action we were required to take against some of the plaintiffs for improper conduct rather than based on any real merit,” Yelp said in an e-mailed statement.But Yelp makes no bones about the fact that its entire business model is based on user reviews, and it routinely cites the potential shortage of new reviews as one of the biggest threats to its business. And the company even pays some reviewers to prime the pump when entering new markets. Mostly, however, Yelp has to persuade people to do the work for free. The most interesting thing about the lawsuit may be its description of how this works:“Yelp has devised a system of cult-like rewards and disciplines to motivate its non-wage-paid writers to labor without wages or expense reimbursement, in violation of equitable principles and the FLSA [Fair Labor Standard Act], by offering such rewards as trinkets, badges, titles, praise, social promotion, free liquor, free food, and free promotional Yelp attire, such as red panties with ‘Make Me Yelp!’ stamped across the bottom.”So the plaintiffs aren’t quite saying that Yelp isn’t giving them anything in return—the claim is more that volunteer reviewers have been so manipulated by free drinks, baubles, and emotional rewards that they’ve been tricked into serving as de facto employees. If Yelp can direct its users’ labor through these means, the plaintiffs contend, then it should have to pay real wages to its pseudo workforce, not just hand out playful underwear.Yelp isn’t the only company to woo people who write consumer reviews. A recent report on NPR’s Planet Money looked at Amazon’s Vine program, through which prolific reviewers are actually sent free products so long as they promise to review them. Michael Erb, one of Amazon.com’s (AMZN) top reviewers, says the giant online retailer lets him pick two brand-new items every month. While those products aren’t officially his property—Amazon can ask for them back at any time—Erb has never been asked to return anything.The concern that Planet Money raises about Vine is essentially the opposite of the argument made in the lawsuit against Yelp. If someone is being compensated in any way, are they really leaving a simple customer review? Amazon dismissed the idea that people are swayed by the swag, saying that average reviews from Vine contributors award fewer stars than people who aren’t in the program. It marks its Vine reviews, although the site doesn’t make it entirely clear what’s going on behind the program. Yelp likewise discloses when a review has been written by one of its paid “scouts.”For its part, Yelp says the incentives it gives out aren’t tied to specific reviews and insists no one gets a free restaurant meal in exchange for a write-up. If users are willing to churn out reviews for some digital badges like Yelp’s “elite” status and an occasional cocktail party for prolific contributors, it seems well within the company’s rights to oblige them. Yelp has denied the allegations.I\'m not taking a side on this issue -- and even if I did, it wouldn\'t matter. The reality is that Yelp is one of the most widely used and respected online search and review services among consumers. So, small businesses can\'t afford to ignore it. Whatever your feelings about Yelp, you need to understand how to make the most of the ranking system if your company is regularly reviewed on the site.Consider the following factors, which play a role in getting your business a good ranking in Yelp\'s internal search results:Related: Yelp to Business Owners: Don\'t Try to Game Our SystemFill out your profile completely: Like many of the engines we\'ve covered in this alternative search series, Yelp values businesses that have filled out their profiles to the greatest extent possible. So, take advantage of this easy-to-achieve ranking factor and fill out as many of the business information fields as you can, including your company\'s hours of operation, website address, pictures and more.Ask for reviews: It\'s against Yelp\'s terms of service to pay reviewers or to engage in review trading scams. You can offer a discount that Yelp users claim through the site (for example, a $20 gift certificate for $10). Yelp then promotes your profile to a wider audience in an effort to generate revenue via deal purchases, resulting in greater visibility for your company.Before you sign on the dotted line, be sure you understand the promotion. There are no upfront costs to creating a Yelp Deal, but Yelp does retain a small percentage of the money generated by deal sales. While you might like to do a Yelp Deal, keep in mind that it isn\'t necessary to get your business ranked higher in the search listings. Online reviews a thorny issue for small-business owners

October 26. 2013 10:45PMVIRGINIA BRIDGES The News &amp; Observer&nbsp;Mobley&rsquo;s Shoes&rsquo; whole business concept depends on its customer service.&nbsp;Since 1950, the store has been providing and fitting shoes for children and women and has depended on its customer service to compete against larger stores.&nbsp;That&rsquo;s why the owners of the Raleigh, N.C., shop are concerned about the filtering of online reviews on Yelp, a website that allows customers to rate and review businesses. The site has a practice of filtering reviews and showcasing ones that have been chosen by data processing software.&nbsp;Mobley&rsquo;s Yelp site shows that the shoe store has one review with a three-star rating from 2008. There are additional reviews, but they have been filtered by Yelp. The filtering system, said Clifton Mobley, who runs the store with his father and his brother, is frustrating because it makes it hard for others to see those positive reviews.&nbsp;Also, one review can end up representing the company for years, he said.&nbsp;Yelp was founded in 2004 and has an average of 108 million unique monthly visitors and more than 42 million reviews. According to a 2013 Nielsen study, about 85 percent of consumers find local business information online. Also, about 70 percent of consumers trust online reviews somewhat or completely, according to a 2012 Nielsen study. Online opinion was second only to recommendations from people they know.&nbsp;Mobley and others are learning to navigate Yelp and its review and filtering process. Here are some things to know before using Yelp.&nbsp;WRITING FAKE REVIEWS IS ILLEGAL: Federal truth in advertising guidelines require transparency any time there is a product or service review, according to Glen Gilmore, an attorney and social media expert who teaches at Rutgers University Center for Management Development in New Jersey.&nbsp;In 2009, the Federal Trade Commission updated its endorsement guidelines to include social media, Gilmore wrote in an email. The guidelines say any connections between a reviewer and the business that&rsquo;s being reviewed need to be disclosed. This means reviewers should disclose whether they are an employee or a relative, or whether they received a free or discounted service or product, Gilmore said.&nbsp;When people sign up for a Yelp account &mdash; either as a consumer or as a business claiming an account &mdash; they agree to limit their reviews to first-hand experiences and to not endorse themselves or write negative reviews about competitors.&nbsp;Many states have laws similar to the federal regulations.&nbsp;REVIEWERS CAN BE SUED: Reviewers can be held accountable for malicious and false reviews.&nbsp;&ldquo;People are entitled to express their opinion about a meal or service online, but they&rsquo;re not entitled to lie in what they post without exposing themselves to a lawsuit,&rdquo; Gilmore wrote.&nbsp;There is no protection from being sued for defamation, the communication of false fact that damages the reputation of another, just because they post it on a third-party website, he said.&nbsp;If a business has concerns about a Yelp review, it should first reach out to the site.&nbsp;Mobley contacted Yelp after suspecting that a negative review had been posted by a former employee; Yelp removed the review.&nbsp;If the site refuses to remove a fake review, the business can file a lawsuit that seeks to establish the identity of the reviewer to demonstrate a case for defamation.&nbsp;&ldquo;Unfortunately, this is a lengthy and costly process,&rdquo; Gilmore wrote.&nbsp;Review sites are protected by a federal law that essentially gives immunity to providers of interactive online services from claims related to content posted by third parties, he wrote.&nbsp;ALGORITHM USED FOR FILTERS: Yelp representatives said the company uses an algorithm to highlight and identify useful and authentic reviews, but some owners say that the practice is used to leverage advertising.&nbsp;About 25 percent of Yelp reviews are filtered, said Darnell Holloway, Yelp&rsquo;s senior manager of local business outreach. The system, which sometimes allows authentic reviews to be filtered while fake reviews get through, isn&rsquo;t perfect, but the company&rsquo;s intention is to provide useful information to consumers, he said.&nbsp;&ldquo;Our software treats advertisers and non-advertisers exactly the same,&rdquo; Holloway said. &ldquo;There is no correlation between whether or not a business chooses to advertise and the activity of a review filter.&rdquo;&nbsp;Yelp started to recognize fake reviews shortly after it was founded, Holloway said. So it created a filter to highlight authentic content. The filtered reviews are located on each business&rsquo; Yelp page. To see them, however, users must click a link and fill out a &ldquo;Captcha&rdquo; code.&nbsp;RESPOND TO NEGATIVE REVIEWS: Don&rsquo;t obsess over negative reviews, said Angela Connor, senior vice president and group director at Capstrat, a full-service marketing agency in Raleigh.&nbsp;Owners should have a system that will help them decide whether and how to respond to negative reviews.
